By accessing, ordering, or utilizing any services provided by SpeedMax LLC, you agree to comply with the terms and policies outlined below.

ℹ️

Policy Overview

SpeedMax LLC provides high-performance shared hosting. To protect all clients on our network, we enforce strict zero-tolerance policies against malicious activities, spam, illegal content, and resource abuse as detailed in our AUP.

1

Acceptable Use Policy (AUP) & Server Rules

All customers must maintain compliance with state, federal, and international laws. The following activities are strictly prohibited on all SpeedMax servers:

  • ✕ Illegal Activities & Cyberattacks: Explicit illegal use of the server is prohibited, including but not limited to brute-force attacks, hacking, cracking, port scanning, and DDoS (Distributed Denial of Service) execution or facilitation. Distribution of illegal materials is strictly barred.
  • ✕ Unsolicited Email (SPAM): Sending unsolicited commercial email (UCE/SPAM) is strictly forbidden. All email mailing lists must be verified opt-in and provide clear, functioning unsubscribe/opt-out mechanisms.
  • ✕ Piracy & Copyright Infringement: Piracy, torrent trackers, warez, and unauthorized copyrighted content are not allowed.
  • ✕ Resource Abuse: Excessive consumption of shared server resources (CPU, RAM, I/O) that degrades server stability for other tenants is prohibited.
  • ✕ Child Exploitation Material: Zero tolerance for child pornography or exploitation material. Any infraction will result in immediate service termination, permanent ban, and immediate reporting to law enforcement authorities.
  • ✕ Hate Groups & Harassment: Hate groups, discrimination hubs, and harassment websites are prohibited and subject to immediate suspension.
2

SpeedMax LLC Rights & Account Governance

To maintain network integrity, server performance, and security across our Las Vegas facility, SpeedMax LLC retains the right to:

  • • Disable, suspend, or terminate client accounts at any time, with or without reason, if policies are violated or server stability is compromised.
  • • Refuse renewal or future provision of services at the company's discretion.
  • • Apply security filters, rate limits, and routine patches to server daemons (LiteSpeed, MySQL, cPanel) to protect hosted accounts.
3

Liability Limitations & Support Scope

Data Liability & Warranty Disclaimer

SpeedMax LLC is not liable for loss of data, lost profits, or any direct, indirect, or consequential damages resulting from service interruptions, hardware anomalies, technical inaccuracies, or typographical errors. While SpeedMax LLC maintains multi-weekly offsite backups, customers are strongly encouraged to maintain their own independent local backups of critical files and databases.

Third-Party Software & Scripts

SpeedMax LLC has no control over third-party scripts, custom software, or external web applications installed by customers and is under no obligation to provide custom software development or third-party code debugging support.

4

Billing & Pre-Paid Subscriptions

SpeedMax LLC operates an automated billing and invoicing system via our Client Portal at my.speedmax.net ». All hosting services are structured on a pre-paid basis.

  • • Payment must be received prior to the beginning of the upcoming service term (monthly or annual).
  • • If payment is not settled for the subsequent period, service provisioning will cease for that billing cycle.
  • • SpeedMax LLC is not responsible for inadvertent payment errors caused by third-party financial intermediaries or user oversight.
5

Policy Updates & Abuse Reporting

These Terms of Service and Acceptable Use Policies (AUP) are subject to revision at any time, with or without prior notification. Continued usage of SpeedMax services constitutes agreement to the updated terms.
